TERMS OF SALE

Please review these Terms of Sale carefully as these terms govern your purchase of the products in your order (the “Products”) from MILE Technology Inc. ("MILE," “we,” “us” or “our) and set out your rights and obligations with respect to your purchases. These are the Terms of Sale under which we are willing to provide you with the Products. Please be certain you understand them.  MILE’s Terms of Service and Privacy Policy are incorporated herein by reference.

By purchasing the Products, you agree that you have read these Terms of Sale and are legally bound by these Terms of Sale.

 

Account and Ordering

An account and Membership (as defined in the Terms of Service) are required to shop on our website or mobile application. Please confirm that your email address and other contact details are accurate when creating your account and placing your order, as we will use the contact that you provide us to contact you. 

Once an order is placed, we are unable to cancel or make any changes at your request. Orders may be shipped from anywhere in the world. Once your order has shipped, you will receive an email (or SMS text message if you provide us with your mobile phone number) containing the tracking information. Please note, it can take 24-48 hours for tracking updates to appear once the order has been shipped.  Order status and tracking information can also be found in your MILE account.   You may receive additional emails and text messages about the status of your order.  If you wish to stop receiving text messages about your order, respond “STOP.”  Standard message and data rates apply. 

 

No Prohibited Purchases

To place an order, you must be at least 18 years old. You agree not to make any purchases or use or attempt to use the Products for any illegal, unlawful purpose, unauthorized, unethical or fraudulent purpose.  You also agree not to transfer or otherwise provide the Products to any third party for any illegal, unlawful, or fraudulent purpose, or in contravention of these Terms of Sale.

 

Sales to End Users Only

Purchases made through the MILE website or from the MILE mobile application are for end user customers only. To the extent permitted by applicable laws, any offers of transfers, transfers, offers of sale, sales or resales to dealers, resellers or distributors or any other third-party anywhere in the world are strictly prohibited. If we believe you are involved in purchase for resale or in violation of these Terms of Sale, MILE reserves the right to, without limitation of any other available remedies, restrict sales to you, cancel your orders, and/or suspend or close your account. 

 

Payment Methods and Shipping

MILE accepts Visa, Mastercard or American Express credit cards and debit cards as well as PayPal, Google Pay, Apple Pay or Shop Pay online forms of payment. Some online payment services may require you to create an account with them. If a credit card is being used for a transaction, MILE may obtain a pre-approval from the credit card company for an amount up to the amount of the order. Billing to your credit card occurs at the time of purchase or when the order is shipped. 

While some of the Products you purchase on our website or mobile application may be fulfilled by MILE, due to the nature of our website and mobile application as an online marketplace, some of your purchases may be fulfilled and shipped directly by a third party vendor. By placing an order, you understand and agree that your information and personal information, including your name, address, phone number and other contact and shipping details, and the contents of your shopping cart may be shared with third party vendors to process your payment and fulfill your order.

Delivery will be by common carrier F.O.B Product delivery address, as entered by you for the applicable order. You assume sole risk of loss or destruction to the Products once the Products have been delivered. Upon delivery, please inspect the packaging for damage. If it appears that the Products are damaged, please do not accept the shipment. 

Shipping costs are non-refundable, even if you need to return an item, unless the return is due to a Product defect. In the case of refused deliveries, the total delivery shipping cost and customs or duties amounts that are applied by the destination country will be subtracted from any refund that you receive.

 

Prices

Your total price will include the price of the Products in your order plus any applicable sales tax, value-added tax, any other applicable tax of levy that we are required to collect, and shipping charges, less any discounts offered. MILE reserves the right to change prices for Products offered at any time, and does not provide price protection or refunds in the event of a price drop or promotional offering. Exact shipping rates depend on the country where your order is being delivered to.

Prices are quoted in the local currency of the country to which the phone or device you have used to access your account is registered. If you update the settings of such device to change its location to another country while browsing or during check out, prices from that moment may be quoted in a different currency, which may have an influence on the price due to a change in currency or to country specific pricing. If your local currency is different from the currency in which the prices are quoted, your bank will apply the exchange rate applicable per the date of purchase. Your bank may apply a different exchange rate, which is beyond our control.

 

Canceled and Rejected Orders

All orders for Product are subject to availability. We explicitly reserve the right to cancel or not to accept your order for any reason, or no reason at all, in our sole and absolute discretion. We also reserve the right to cancel your order by written notice to you in the following situations, without being liable for any damage or costs other than repayment of any amount received from you in relation to the order we cancelled:

  • the Product is not in stock or is unavailable;
  • the information your provided to us, such as your billing information, is not correct or not verifiable;
  • your order is flagged up by our security systems as an unusual order or an order susceptible to fraud;
  • your payment method failed;
  • we believe you are prohibited from making a purchase, such as you are under the legal age in your country;
  • we believe that you are a reseller;
  • there was an error in the price displayed on our website;
  • we could not deliver to the address provided by you; or
  • we believe you have violated these Terms of Sale.

 

Promotions

From time to time, MILE may offer discounts or coupon codes and/or other offers for free or discounted products or services for promotional purposes, including via loyalty and rewards programs (collectively, “Promo Offers”).  To the extent permissible under applicable laws, the following rules apply to any such Promo Offers made by MILE such as through our website, mobile application or through any other direct to consumer communication.  Terms and conditions for each Promo Offer may vary, but unless expressly stated otherwise, the following terms will be deemed to apply, with any conflicts being governed by the terms specified in the Promo Offer.

  • Promo Offers can only be redeemed on purchases made directly from MILE, such as through our website or mobile application (“Promo Offer Sales”).
  • Promo Offers may not be combined, are non-transferrable, and have no cash value.  Promo Offers cannot be sold or otherwise bartered, are limited one per registered household, and are void where prohibited.
  • Customers who redeem a Promo Offer shall be responsible for any applicable taxes or fees associated with the corresponding Promo Offer Sale.
  • Promo Offers are for a limited time only, subject to any express expiration date and/or supply availability limitations.  If no expiration date is provided, the Promo Offer will be deemed to expire from the earlier of (1) when the Promo Offer is terminated or otherwise removed by MILE or (2) after six (6) months from date the Promo Offer was first communicated to the end user recipient.  Promo Offers do not apply to prior sales or orders.  To the extent permitted under applicable law, Promo Offers may be discontinued at any time at MILE’s sole discretion.
  • MILE’s Terms of Sale and Terms of Service apply with respect to any Promo Offer Sales. 
  • All Promo Offer Sales are subject to Product availability.
  • MILE reserves the right not to accept orders (involving a Promo Offer or not) where MILE has any reason to suspect that any part of said order involves fraudulent activity or violates these Terms of Sale.
  • Subject to any other applicable terms and conditions mentioned herein, in the event any item included in a Promo Offer Sales order is returned MILE may at its sole discretion determine that such partial returns are only qualified for replacements.  Where MILE decides to issue a refund, the amount refunded will not exceed the price paid for that item(s) under the applied Promo Offer.
  • Promo Offer terms may vary by Product.
  • MILE reserves the right to cancel any order relating to fraudulent or any other misuse of Promo Offers.

 

Sales Tax & Value Added Tax

MILE website and mobile application transactions will include sales tax based on the delivery address and the sales tax rate in effect at the time your transaction is completed. If the sales tax rate for the state to which your order is being shipped changes before the product is shipped, the rate in effect at the time your order was received will apply. You are responsible for all applicable sales taxes, and MILE has the right to collect any tax it believes it is obligated to collect.

For customers located in the United Kingdom ("UK Customers"), the seller of record is Box of Heat Ltd, a company registered in England and Wales with its registered office at Unit 12a 31 East Business Park, Kingfisher Way, Dinnington, Rotherham, United Kingdom, S25 3AF, registered under company number 12290896 and VAT number GB 337137210. Box of Heat Ltd is responsible for processing sales to UK Customers and providing related services.

Box of Heat Ltd may collect and remit applicable Value Added Tax (VAT) on purchases made through MILE website and mobile application in accordance with UK tax laws. As a VAT-registered entity in the UK, Box of Heat Ltd complies with all relevant HMRC regulations regarding VAT collection and reporting. Where required under UK VAT law, Box of Heat Ltd, acting as an online marketplace operator, will collect and remit VAT for transactions facilitated through MILE website and mobile application. For Products owned and sold directly by MILE, Box of Heat Ltd is responsible for charging and remitting VAT in compliance with UK regulations. UK Customers may receive VAT invoices where applicable, in accordance with UK legal requirements.

By purchasing products or services through MILE website and mobile application, UK Customers acknowledge and agree that prices displayed on MILE website and mobile application may include VAT, where applicable. VAT-exempt purchases must comply with UK tax laws, and appropriate documentation may be required. Business customers must ensure the accuracy of their VAT registration details if claiming VAT deductions or refunds, subject to applicable legal requirements.

Box of Heat Ltd reserves the right to update its VAT collection policies in response to changes in UK tax regulations. Any material changes affecting purchases will be communicated to customers. For UK Customers, these Terms are governed by the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. Please contact support@mile.club for VAT-related inquiries.

 

International Orders

When ordering Product(s) for international delivery, customs authorities may inspect and open the package, and import duties and taxes may apply upon reaching the designated destination. The responsibility for paying these import duties and taxes rests with you. It's important to be aware that MILE has no control over these charges and cannot anticipate their specific amount. Prior to placing your order, you may request additional information from your local customs office.

 

Returns and Exchanges:

We do not offer returns or exchanges for Products and all sales are final.

If you receive damaged or defective Products or experience a quality issue, please contact our customer support team at support@mile.club within twenty-eight (28) days of receiving the damaged or defective Product. Following receipt of your notice of a damaged or defective Product, we will provide assistance on a case-by-case basis to address the issue, which may include a replacement or refund, subject to our sole discretion. 

Upon approving your exchange or refund for a damaged or defective Product, you will receive a prepaid return label (print your label at home) along with instructions on how to send you return to us via email. Exchanges will be processed once we have confirmed items eligible for return have been received by the applicable sender Please note: all refunds will be issued to your original form of payment. Please allow up to 10 business days for your return to be processed once it arrives at our facility. You will receive an email once your return has been processed and we have issued your refund.


Returns Policy (UK Customers Only):


This Returns Policy applies exclusively to customers within the United Kingdom who purchase clothing, shoes, accessories, bags, and related items from our website. In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods without providing any reason. This period is known as the "cooling-off period." If you wish to return an item, you must notify us within 14 calendar days from the date you receive your order. To initiate a return, please contact our customer service team at support@mile.club with your order details.

Please note that the items must be returned in their original condition, unused, unworn, unwashed, and with all original tags and packaging intact. Returns that do not meet these conditions may not be accepted. For hygiene reasons, certain items such as earrings, swimwear, and underwear cannot be returned unless faulty. If you receive a faulty or incorrect item, please contact us immediately at support@mile.club. In such cases, we will cover the cost of return shipping and provide a full refund or replacement, as applicable.

Refunds will be processed within 14 days of receiving the returned items, provided they meet the return conditions. Refunds will be issued to the original payment method. Please note that original shipping fees are non-refundable.

Product Variations and Care

Minor differences in color and other variations in Products are possible as a result of different image acquisition, display technologies or other technical reasons. We are not liable for any such variations or deviations.  Please review all washing and maintenance instructions printed on the labels of the Products. We are not liable for any damage resulting from incorrect washing of Products, including washing contrary to the instructions.

 

Limitations of Liability and Dispute Resolution

Your orders and purchases are subject to the limitations of liability and all other terms of our Terms of Service.  Please note that the Terms of Service also require the use of binding arbitration to resolve disputes rather than jury trials or class actions (please see details in our Terms of Service). For UK Customers only, all matters concerning your order, the Terms or Sale, and the Terms of Services shall be governed by English law. Any disputes or claims arising from these terms shall fall under the exclusive jurisdiction of the courts of England and arbitration shall not be binding to resolve disputes for UK Customers.
